1. Introduction: These terms and conditions govern the agreement between SP Photography and the client for a photography session. By booking a session with SP Photography, the client agrees to be bound by these terms and conditions.
  2. Booking and Payment: The client shall pay a deposit to secure the session date and time. The deposit is non-refundable unless SP Photography is unable to provide the session due to circumstances beyond their control. The remaining balance shall be paid on or before the session date unless full payment at the point of booking. SP Photography reserves the right to cancel the session if full payment is not received.
  3. Cancellation: The client may cancel the session by providing written notice to SP Photography at least 7 days prior to the session date. If the client cancels the session less than 7 days prior to the session date, the client shall forfeit the deposit.
  4. Rescheduling: The client may reschedule the session by providing written notice to SP Photography at least 7 days prior to the session date. SP Photography will make reasonable efforts to accommodate rescheduling requests but cannot guarantee availability.
  5. Late Arrival: If the client is late for the session, the session time will not be extended. If the client fails to arrive at the session location within 30 minutes of the scheduled time, the session shall be cancelled and the client shall forfeit the deposit.
  6. Image Ownership and Usage: The client retains the copyright to the images produced during the session but grants SP Photography a non-exclusive, worldwide, perpetual license to use the images for promotional and marketing purposes. SP Photography shall have the right to reproduce, distribute, and display the images in any media format.
  7. Image Delivery: SP Photography will provide the client with a digital gallery of the edited images within 2 weeks of the session date. The client will have access to the digital gallery for 12 months from the date of delivery and maybe extends for a fee £10 per 12 months.
  8. Image Retouching: SP Photography will retouch a reasonable number of images from the session. Additional retouching requests may incur additional fees.
  9. Refunds: No refunds shall be given due to the digital nature of the photographs.
  10. Equipment Failure: In the event of equipment failure, SP Photography will make reasonable efforts to reschedule the session at no additional cost to the client. If rescheduling is not possible, the deposit shall be refunded.
  11. Force Majeure: SP Photography shall not be liable for any failure to perform or delay in performing any obligation under these terms and conditions if such failure or delay is caused by any event beyond their reasonable control.
  12. Liability and Indemnity: The client agrees to indemnify and hold harmless SP Photography, its affiliates, employees, and agents from any and all claims, damages, expenses, or liability arising from the use or publication of the photographs, including but not limited to claims for defamation, invasion of privacy, or infringement of copyright. SP Photography is not responsible for any injury or damage sustained by the client during the photography session. The client agrees to assume all risks associated with the photography session and to release SP Photography from any liability for any injury or damage that may occur during the session.
  13. Allergies: Cake Smash Sessions: It is the Client’s responsibility to inform SP Photography of any food allergy or intolerances the Client’s baby has prior to ordering the cake. SP Photography will not be held liable for any adverse effect or illness the baby may suffer as a result of an allergy if the Client did not inform the Photographer.
  14. Exclusivity: SP Photography shall be the exclusive photographer retained by the client for the purpose of photographing the session. The client agrees that no other party, including but not limited to guests, family members, or other photographers, shall interfere with SP Photography’s performance during the session. The client acknowledges that SP Photography’s ability to capture certain shots may be compromised if other parties are taking photographs at the same time. Therefore, the client agrees to prevent any interference with the photographer’s duties during the session.

These terms and conditions constitute the entire agreement between SP Photography and the client and supersede any prior agreement or understanding, whether written or verbal. These terms and conditions may only be amended in writing and signed by both SP Photography and the client.

The client acknowledges that they have read and understood these terms and conditions and agrees to be bound by them. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Any disputes arising from these terms and conditions shall be subject to the laws of the jurisdiction in which the photography session takes place. The parties agree to first attempt to resolve any disputes through mediation before resorting to litigation.

By booking a session with SP Photography, the client acknowledges that they have read, understood, and agree to be bound by these terms and conditions.
